LIMITED WARRANTY

 

Double J Concrete & Masonry, a Minnesota corporation (“Double J”), hereby warrants that its work shall be done in a workmanlike manner according to standard building industry practices (“Limited Warranty”).  Double J provides this Limited Warranty on all of its workmanship for a period of one (1) year running from the date that Double J ceases work on the property (“Limited Warranty Period”).

All materials used are subject only to warranties provided by the manufacturers and/or suppliers, if any.  If Double J is not paid in full in accordance with the underlying Contract and/or Change Orders, all warranties, express or implied, are null and void.  Double J’s Limited Warranty is only enforceable by its contracting customer and is not transferable to any subsequent property owners, persons, or entities.  Double J does not warrant or guarantee previous workmanship or pre-existing materials, or any materials or labor that Double J did not originally provide. Double J does not warrant and does disclaim responsibility, and Customer holds Double J harmless, for any consequential, incidental or other damages related to water intrusion, including but not limited to mold or mold remediation, beyond warranting and repairing Double J’s workmanship within the Limited Warranty Period.  Double J is not responsible for latent defects in materials and accessories supplied.  Double J shall not be responsible for rework required as a result of the acts or errors of others.  Subsequent work or attempted repairs by any other entity in connection with the labor and materials Double J provided voids Double J’s Limited Warranty.

Double J must be notified in writing of any purported issues covered by this Limited Warranty within 5 days after your discovery of the issues.  Telephoning will not preserve your rights. Failure to report issues to Double J within this time period will render this Limited Warranty null and void with respect to any such issues and all claims against Double J for those issues will be waived.

Repair and On-Site Inspection Policy:  Double J stands behind its work and will promptly address any alleged issues covered by its Limited Warranty during the Limited Warranty Period. Upon inspection and determination that the alleged issues are covered under this Limited Warranty, Double J, in its sole discretion, will choose and apply the appropriate remedy. However, please be advised that Double J will not repair free of charge issues related to the work of others or that are not otherwise covered by Double J’s Limited Warranty.  Please know that if Double J visits the project pursuant to a customer’s or other party’s written request and finds that the alleged issue is not due to Double J’s work or otherwise not covered under Double J’s Limited Warranty, Double J reserves the right to charge the customer or the party $100 for the service call.

Please review the attached industry standards and Limited Warranty exclusions prior to providing written notice of any purported issues during the Limited Warranty Period in order to avoid being charged for service calls.

Concrete Industry Standards and Exclusions

 

  1. Concrete Cracks: driveways, patios and sidewalks should have expansion and contraction joints. These joints help guide the natural cracks that will develop. Regularly, cracks will exit or form outside of control join locations. Random cracking is to be expected.
    1. Standard: Random cracking of concrete will occur and is to be expected at any point during its lifetime. If settling causes cracks that exceed 1/4" in width within the Limited Warranty Period, it will be considered for repair or replacement.
    1. Double J’s Responsibility: Double J is responsible for correcting only those cracks that exceed 1/4" in width within the Limited Warranty Period. An appropriate joint or crack filler can be used and is acceptable for a crack up to 1/2 inch in width or vertical displacement.
    1. Customer’s Responsibility: Small cracks must be filled with waterproof concrete caulk to prevent the cracks from becoming larger.
  1. Puddles on Concrete: Low spots in concrete in which water pockets appear, not caused by conditions states in the Background.
    1. Standard: No measurable water depth exceeding 1/2 inch is acceptable on concrete for more than 24 hours after rain has stopped. This standard does not apply to stamped or decorative surfaces.
    1. Double J’s Responsibility: Double J will correct to meet the standard as needed. However, color and texture variations are to be expected.
  1. Spalling: spalling, scaling, pitting, or pop outs are to be expected in extreme weather regions.
    1. Double J’s Responsibility: Double J is not responsible for damage that is the result of spalling, scaling or pitting caused by salt, chemicals, mechanical implements, or other factors beyond the Double J’s control. Corrective action may include one of many options such as re-sealing or resurfacing the affected area.
    1. Customer’s Responsibility: The customer must take precaution to reduce or eliminate the exposure of exterior concrete to salt, chemicals, mechanical implements, and other factors which could damage the concrete surface. Customers should have their concrete driveways and sidewalks sealed with a penetrating concrete sealer 30 days after it is poured and every fall season, before winter, thereafter.
  1. Stains: Concrete is a porous, natural product that absorbs such substances as petroleum-based products, solvents, and paints. When a liquid enters concrete, it can seep from top to bottom or bottom to top (a stain may appear from underneath the surface, even if nothing was spilled upon the top surface of the concrete). It should also be expected that mud from site could get into the porous surface of concrete. This is beyond the control of the Double J and falls within the parameters of the standard.
    1. Standard: Interior and Exterior Concrete will stain.
    1. Double J’s Responsibility: None.
    1. Customer’s Responsibility: The customer must take precautions to prevent petroleum-based products, solvents, and paint from coming in contact with concrete surfaces. By keeping stain remover on hand, many stains can be made less visible if treated immediately. (It should be noted, however, that these products may also weaken the surface of concrete. Customer is responsible for choosing the correct product and using the product according to manufacturer’s instructions.)
  1. Background: Concrete consists of a mixture of many natural materials: water, cement, sand, gravel, fly ash and other various admixtures. These materials are combined in many different ways according to the specific use of th finished concrete, regional requirements, and climate.  Because it is a natural product, it is difficult to control how it will react to various conditions that are beyond the control of both Double J and the Customer.

Naturally occurring conditions affect concrete in numerous ways. Minnesota is classified as a Severe Weather Region for concrete. NAHB defines a severe weather region as outdoor exposure in a cold climate where concrete may be exposed to the use of deicing salts or where there may be a continuous presence of moisture during frequent cycles of freezing and thawing. Exposure to severe weather can damage pavements, driveways, walks, curbs, steps, porches, and slabs in unheated garages. Destructive action from deicing salts may occur whether from direct application or from being carried onto an unsalted area from a salted area, such as on the undercarriage or tires of a vehicle traveling onto an unsalted area from a salted area. Concrete expands and contracts with temperature changes. This is especially a concern during the first year after concrete has been poured, because it the concrete retains a lot of water.

Another characteristic of concrete that is outside of Double J’s to control is color variations. Concrete itself can have varying colors due to the different types of sand and aggregates used in the mixture. Color variations can also be caused by admixtures such as calcium chloride, (the most commonly used admixture to accelerate the curing process of concrete and to reduce the effects of freezing). If concrete is poured on different days, and the previously poured concrete has had time to cure, color difference may be apparent. Different brands, types, and batches of concrete may contain many varieties of sand, cement, admixtures, and aggregate that will result in color variations in the finished concrete. When repairs are made, the concrete used as a filler must be extremely dry to prevent shrinkage. This almost always results in a repair patch that is darker in color than existing concrete. Because of the previous explanations for color variations, it is to be expected that whenever a repair is made, it is nearly impossible to match the colors of concrete. Because the curing of concrete is a chemical process and can take up to one year to complete, changes in size and strength are to be expected. It is very difficult to control the effects of water evaporation, air bubbles within the concrete, air humidity, and wind. Some chemical processes are only controllable and are the responsibility of the Customer. Pitting, spalling, or scaling can occur when salt or other deicers are applied directly to the surface of the concrete or when they are indirectly deposited on the surface by tires or feet. These substances cause rapid deterioration of the surface, by both chemically attacking the concrete and by drawing moisture near or within the surface and promoting expansion and contraction of the concrete during the freeze-thaw cycle. Other chemicals, such as lawn fertilizer, can also chemically attack the surface of the concrete, resulting in spalling, scaling, and pitting. Until concrete has cured, it cannot withstand extreme weight such as moving vans, school buses, or garbage trucks. It is especially important to limit the amount of weight that is placed upon concrete during the first year because it needs sufficient time to cure and gain strength.

  1. Exclusions: This Double J Limited Warranty excludes the following items:
    • Acts of God or damages caused directly from abuse outside of normal usage
    • Chips, flaking, spalling or surface wear in any way
    • Any displacement or chipping between new and old or existing concrete  or pavements
    • Sealers
    • Drains, Pipes, or Downspouts
    • Concrete Patches or Repairs
    • Overlay Products
    • Epoxies
    • Coatings of Any Type
    • Special Finishes
    • Landscaping
    • Asphalt Repairs
    • Painting or Caulking
    • Woodwork
    • Firepits, Benches, and Pergolas
    • Concrete Work Designed by Others, Subject to Heavy or Commercial Use, Approaches, Aprons, Shop Floors or Work Done in Accordance to Outside Source/Private Designs or Mixes.
    • Concrete  Coloration
    • Decorative Concrete or Finely Finished  Surfaces

Epoxy Industry Standards and Exclusions

  1. Standards:
    1. Due to the uncontrolled color tinting from each color batch, colors, textures, patterns and shading may vary across larger areas.
    2. Color and texture samples provided by Double J are approximate only and may vary from the completed project.
    3. The portion of epoxy that extends to any exterior area may fade after a period of time due to weather conditions.
  1. Exclusions:
    1. Damage or dulling of finish caused by prolonged use or customer negligence, including, but not limited to: heavy use, lack of proper maintenance and care, application or spilling of harsh chemicals, cleaning with abrasive materials and/or detergents, the use of pressure washers and/or scrubbing/buffering machines
    2. Damage caused by outside forces, including, but not limited to, scratches, impacts, spinning tires, fire or excessive heat, mechanical damage to underlying concrete, lack of maintenance and cleaning.
    3. Damage, blistering, peeling, or any condition caused by or related to concrete osmotic pressure or silicates extruding from or out of concrete. These situations are beyond Double J’s control.
    4. Customer is responsible for choosing the correct maintenance products and using such products according to manufacturer’s instructions. 
    5. Damage caused by outside defects in the concrete or substrate underlying the epoxy, including, but not limited to: heaving, shifting, popping, settling, moisture issues, geo-movement and/or structural foundation movement.
    6. Double J will not re-install new epoxy to the entire areas due to color, gloss or sheen differences, texture differences and/or chips not matching.
    7. Fading of epoxy that extends to any exterior area.
